Advocate for President argues that Mchunu’s special leave consistent with constitution


Advocate Ngwako Maenetje SC has argued that President Cyril Ramaphosa has the power to place Police Minister Senzo Mchunu on special leave.

Advocate Maenetje is arguing for President Cyril Ramaphosa at the Pretoria High Court sitting in the Palace of Justice.

uMkhonto weSizwe and former President Jacob Zuma have brought a court application challenging Ramaphosa’s 2025 decisions which includes placing Minister Mchunu on leave of absence.

Advocate Manejtje has argued that President Ramaphosa’s decision is consistent with the Constitution.

“And that is why he said. I want to be informed. You heard a lot of arguments why the Commission’s findings and recommendations are non-binding. That is irrelevant. What the President is saying I want to the allegations to be tested thoroughly so I am informed by findings that are going to be made for me to make a decision. And that is what he explains in his answering affidavit.”
