Chief Justice, Mandisa Maya handed the judgement on Phala Phala matter earlier.
The African National Congress (ANC) says the Constitutional Court’s judgment on the Phala Phala matter nullifying Parliament’s decision to block the Section 89 report is a test of democracy.
It says the judgment will be ventilated at Luthuli House soon.
Speaking to the media on the steps of the court after the verdict, ANC Spokesperson Mahlengi Bhengu says they will continue to respect the constitution.
“ The ANC has always been at the centre of advocating for support for the rule of law, for support for the rule, the bill of rights and at this point in history we are not going to backdown on that. We have got to respect the judgement, we are going to study the judgment and we are going to make amends where we need to make amends. “

Meanwhile, the African Transformation Movement (ATM) says the ruling brings a long-awaited clarity on how Parliament must handle accountability processes involving the executive.
The party says the judgment underscores that procedural mechanisms cannot be used to shield political power from constitutional scrutiny, and that oversight institutions must act within the spirit of the Constitution.
ATM national spokesperson Zama Ntshona says the ruling restores the integrity of the accountability process by reaffirming that no president, governing party, or institution stands above the Constitution.
“We therefore call for the impeachment committee to be convened without delay, for its work to be conducted openly and lawfully, and for the president to cooperate fully with every constitutional and investigative process. We reject impunity and trial by slogan. We stand for truth, fairness and equal justice. This moment will define whether Parliament remains a guardian of constitutional democracy or becomes an instrument for shielding executive misconduct.”
