The High Court in Johannesburg will on Monday hear former Presidents Thabo Mbeki and Jacob Zuma’s bid to review retired Justice Sisi Khampepe’s refusal to recuse herself from the Truth and Reconciliation Commission (TRC) cases inquiry.
The matter will sit in the High Court for the next two days.
The former Presidents claim Khampepe applied a subjective rather than an objective standard on the issue of bias, which they claim will colour her perspective due to her previous roles as a member of the TRC Amnesty Committee and a Deputy National Director of Public Prosecutions (NDPP).
Mbeki also seeks an order that President Cyril Ramaphosa terminate Khampepe’s appointment and declare all decisions, proceedings and acts by the Inquiry that involved her null and void.
