Madlanga Commission rules on Witness F’s WhatsApp evidence


The Madlanga Commission has ruled that the Whatsapp messages of new witness, known as Witness F, should be exhibited before the Inquiry without his active participation.

On Tuesday morning, his lawyers requested a postponement through a High Court application.

WhatsApp messages on the electronic device of Witness F were again the subject of argument at the Madlanga Commission for yet another postponement.

This as Witness F’s legal counsel Hartley Ngoato, filed a formal application with the High Court interdicting the use of WhatsApp texts at the Commission.

Last week, the Madlanga Commission granted Witness F a postponement so that his legal counsel could peruse the over 4 000 pages of information they say were not granted to them on time.

Ngoato has argued that the WhatsApp chats should not be displayed because some of them are factually incorrect and can be self-incriminating.

“They are incorrect in the manner in which they have come from, because the entire bundle of documents, they only show outgoing and ingoing. Even the WhatsApps that somebody forwarded to him and he sent it to somebody, it only shows that he’s the one sending and making him the originator, what is the actual fact, not the originator of the message.”
