Nkabinde rejects claim of protecting Batohi from cross examination


Chairperson of the Nkabinde Enquiry, retired Justice Bess Nkabinde, has criticised National Director of Public Prosecutions, Advocate Shamila Batohi, for insinuating that the retired justice would protect her from being cross examined at the enquiry.

This after Advocate Batohi referred to an alleged telephone conversation she had with Justice Nkabinde prior to the start of the enquiry, where the retired Justice allegedly told Batohi she wouldn’t be cross examined.

Justice Nkabinde has vehemently denied this assertion cautioning Batohi from impugning her conduct or that of her co-chairs at the enquiry.

The Nkabinde enquiry is probing suspended South Gauteng Director of Public Prosecutions Advocate Andrew Chauke’s fitness to hold office, following prosecutorial decisions he took during the racketeering case of the Cato Manor Police Unit dubbed the Death Squad, and the murder, kidnapping and assault charges against former Crime Intelligence Boss General Richard Mdluli.

Judge Nkabinde states her position.

Judge: May I take this opportunity to clarify your statement that I made it clear in Chambers that you will not be cross examined. Did I understand to say that?

Batohi: That is correct chairperson.

Judge: It is important to put context to that question. To that answer rather and place it correctly on record. That it is not correct that I said that you will not be cross examined.
