Tribunal orders ISF Shula Joint Venture to repay fraud profits


The Special Tribunal has ordered the ISF Shula Joint Venture to pay back all profits derived from a fraudulent contract.

The venture is a partnership between ISF Construction Services and Shula Constructions.

It had been granted the R85-million contract to build a concrete border wall between KwaZulu-Natal and Mozambique.

This followed an increase in crime, including the smuggling of hijacked vehicles into Mozambique.

The Special Investigating Unit has welcomed the Special Tribunal’s ruling.

SIU Spokesperson, Selby Makgotho says: “On the grounds of review, when we made the application, amongst others, we found that there were quite a number of irregularities, including the fraudulent submission of a compliance certificate, the letter of spending that was not in compliance with the regulator’s Provision Bureau, and ultimately the money that was paid when the service in question had not been rendered, meeting the requirement. So, ultimately, we found that all these things, the money that had been paid, was not supposed to be paid. And as such, the order grants that in the next 30 days, certain actions must have been taken, including taking disciplinary action as part of consequence management.”
