Suspended Police Sergeant Nkosi’s bail ruling expected on Wednesday


The bail application of suspended police sergeant, Fannie Nkosi, will be finalised on Wednesday. Nkosi was arrested following a raid at his Pretoria North home where dockets, explosives and ammunition were found, earlier this month.

He faces charges including theft, defeating the ends of justice and the unlawful possession of ammunition and explosives. Nkosi has previously told the court that he could afford R10 000 bail.

Nkosi’s, legal representative, Advocate Sizo Dlali, told the Pretoria North Magistrate’s Court that there is no evidence that the dockets found during a raid at his Pretoria North home were stolen.

Dlali argued that the dockets were part of the information that was said to be centralised, which was a directive from the National Police Commissioner, Fannie Masemola.

“How do you now come to the conclusion that those dockets were stolen but at the same time you’re saying that Mr Nkosi was directed to the police station and demanded those dockets to be given to him. These dockets, the president of South Africa, the National Commissioner and the Deputy National Commissioner requested that these dockets be centralised in the national office so that they can be dealt with. These dockets are dockets that involve cash-in-transit and other crimes. You are aware of the charges that Mr Nkosi is facing your worship. The charges that he’s facing relate to failure to mount the safe and the possession of ammunition that he wasn’t supposed to be in possession of, they do not relate to drug trafficking which come from Madlanga Commission, your worship.”

The state is opposing his release, arguing that the evidence suggests he was involved in protecting individuals linked to serious and violent crimes.

“The applicant is being suspended from service. There is likelihood that his employment might be terminated following processes of disciplinary proceedings against him. It is respectfully submitted that the offences the applicant is facing cannot be said to be trivial. They are so grievous, the evidence against him is overwhelming, it is submitted that the applicant may skip bail and evade trial,” says State Prosecutor Advocate Tholoana Sekhonyana.

It was Nkosi’s third court appearance.
