The Nkabinde Enquiry is expected to rule this morning on an application by former National Director of Public Prosecutions Advocate Shamila Batohi.
Batohi has requested permission to consult with her legal representatives while under oath during her testimony. She was previously criticised in December for leaving the enquiry before completing her testimony.
The enquiry is investigating the fitness of suspended South Gauteng Director of Public Prosecutions Advocate Andrew Chauke to hold office.
It is examining allegations of prosecutorial misconduct, including claims of politically motivated decisions and the handling of high-profile cases.
Enquiry spokesperson Tiyisela Mpuzana says the panel will follow established procedures.
“In reaching its decision the Enquiry Panel will apply the procedural rules governing witness testimony and the standard conduct required during public hearings. As the enquiry approaches the end of the public hearing phase, evidence leaders are also expected to provide the Panel with a schedule of upcoming witnesses who will take the stand,” said Mpuzana.
“This transition marks a critical step before the panel begins compiling its final report for submission to the President within the prescribed timeframes,” he added.
