The application for leave to appeal of convicted Matjhabeng Municipality Executive Mayor of Matjhabeng, Thanduxolo Khalipha has been postponed to March 14 for judgment.
Khalipha is applying for leave to appeal a judgment in which he was found guilty on two counts of assault and crimen injuria.
The ruling came after Khalipa assaulted his bodyguards while trying to remove him from angry community members in February last year.
He was sentenced to 5 months imprisonment or R7 000 fine for assaulting his bodyguard.
He has submitted in the Odendaalsrus Magistrate Court that he had no intentions to assault his bodyguard.
Advocate Jerry Merabe, who is representing embattled Mayor Thanduxolo Khalipha says the court erred in finding him guilty of crimen injuria.
Merabe says Khalipha was acting on necessity when he tapped his bodyguard’s shoulder and had no intention of assaulting him.
Merabe adds that the bodyguard was speeding and there were many people and Khalipha saw it necessary to ask him to slow down.
