[FILE] Lekompo musician Lehlogonolo ‘Shebe Maburna’ Chauke in court
The lawyer representing Lekompo musician Lehlogonolo Chauke, popularly known as Shebe Maburna, says the Polokwane Magistrate’s Court did not properly consider new facts when it denied his client bail for the third time earlier this month.
Advocate Michael Khumalo is appealing the ruling on behalf of the musician, who faces 20 charges, including attempted murder, malicious damage to property, and illegal possession of a firearm.
Khumalo argues the court should have treated information presented by the defence, including the musician’s need for medical treatment, as new facts warranting further consideration.
“If the court finds that there are indeed new facts, then the next inquiry that has to be made is whether there are additional costs because this is a scheduled six-bail enquiry. What we are saying is that the findings on the part of the learned magistrate that there are no new facts ended the enquiry, the bail applicant was refused bail on the findings that there are no new facts, and I’m submitting that if there is a new fact, the learned magistrate misdirected himself because he ended the enquiry too soon and wrong,” Khumalo said.
