Lawyer for Mthobisi Mncube, one of the accused in the Senzo Meyiwa murder trial, says the Department of Correctional Service has no basis to keep him in the C-Max section of the Kgosi Mampuru Prison in Pretoria.
Maryna Steenkamp says Mncube’s four-year-long isolated incarceration is unlawful, cruel and inhumane.
She adds that he is locked up for 22 hours and denied enough time to consult with his legal team.
Judgement on Mncube’s urgent application to be moved out of solitary confinement has been reserved until Tuesday next week.
Steenkamp says it is an injustice that her client is kept away from the jail population
“Their reasons for keeping the first applicant incarcerated longer than necessary at C-Max is just a vague comment, high risk and attending a high-profile matter. The three other co-accused are not in C-Max, but they are attending a high-profile matter. The applicant is successful that his right to a fair try was violated because he already complained about that, ‘I cannot concentrate, I cannot give informed instructions, I struggle, please transfer me’.”
