Outgoing National Prosecuting Authority head, Advocate Shamila Batohi.
Outgoing National Prosecuting Authority head, Advocate Shamila Batohi, is now seeking assistance from the newly-appointed National Director of Public Prosecutions, Advocate Andy Mothibi, after her request for state-funded legal counsel was rejected by Justice Minister Mmamoloko Kubayi.
Batohi’s term officially comes to an end next week.
She has been asked to make a substantive application to the inquiry or to return to the minister and seek reconsideration.
The Nkabinde Inquiry is investigating the fitness of suspended South Gauteng Director of Public Prosecutions, Andrew Chauke, to hold office.
Chauke’s legal representative, Advocate Tembeka Ngcukaitobi, has argued that the delays caused by Batohi’s unresolved application are prejudicing his client.
“The context must not be forgotten that we are dealing with a witness who’s taken into her own hands. The second issue is her uniliteral action which impacts on my client who’s on suspension on baseless grounds. Whether he’s right, or wrong he’s entitled to a speedy determination of that question,” adds Ngcukaitobi.
