Court to rule on cross-examination of Zungu on signed statement

The High Court in Pretoria is expected to make a ruling on whether or not Sifiso Gwabini Zungu can be cross-examined on a statement he signed when the Senzo Meyiwa trial resumes on Friday morning.

Both the state and defence have presented arguments on the admissibility of a statement said to be made by defence witness Zungu. This follows interruptions this week over security concerns.

Zungu, who was not in court due to medical reasons, is alleged to have hosted a gathering at a hostel where the five accused were seen the day Meyiwa was murdered.

The Bafana Bafana captain was shot and killed in October 2014, while at his girlfriend Kelly Khumalo’s parental home in Vosloorus, on Gauteng’s East Rand.

Defence counsel Sipho Ramosepele says while the court has the right to all evidence, the statement was signed after the alleged torture of Zungu.

Ramosepele says, “The court must listen to the totality of the evidence. We are saying it is indeed correct, my Lord. As the state says that the statement is critical evidence in this case.”

Judge: “The judge is not here to advance any version of any party. The judge is here to find out what the truth is. The state has got an honour to prove its case beyond a reasonable doubt.”
