Batohi’s legal team wants Nkabinde Inquiry terms of reference amended


The legal team representing National Director of Public Prosecutions (NDPP) head Advocate Shamila Batohi before the Nkabinde Inquiry that is currently under way in Pretoria has sought to amend the terms of reference of the enquiry.

They suggested that a charge of misconduct be added to the list.

The inquiry which is led by retired Judge Bess Nkabinde is probing suspended South Gauteng Director of Public Prosecutions, Advocate Andrew Chauke’s fitness to hold office.

Chauke was suspended in July this year after Batohi complained to President Cyril Ramaphosa.

Nkabinde has advised Batohi’s legal team to approach the Presidency if they wish to have the terms of reference of the enquiry amended.

“If we need not consider your request, the option is to start where the NPA started – by approaching the President. The terms of reference are clear. The terms of amendment fall within the space of the “resident”. “Not necessarily us. But if we are to consider, it should be put in an application so that we can consider that.”
