Ramaphosa, govt’s bid to halt constitutional damages case dismissed


The High Court in Pretoria has dismissed, with costs, President Cyril Ramaphosa and the Government’s bid to halt the constitutional damages case against them.

The case seeks to hold government accountable for its conduct in obstructing the investigation and/or prosecution of apartheid-era cases referred by the TRC to the NPA.

Ramaphosa and the State sought a stay of the matter brought by the families and survivors of apartheid-era human rights violations, pending the outcome of the TRC Cases Inquiry.

The High Court, in a judgment dated 3 October 2025,  found that these families, who have waited 20 years for justice, have a right to have their dispute finally determined.

The Court further noted that it was ironic that the government, which is the sole cause of this delay, is seeking the court to sanction yet another delay without pointing to any tangible benefit that will be achieved by the delay.  As a result, the court concluded that it was not in the interests of Justice to grant a stay of proceedings.
