Five accused in the former Bafana Bafana captain Senzo Meyiwa murder trial appear in the High Court in Pretoria.
The Defense counsel in the Senzo Meyiwa murder trial has argued that the testimony by key state witness Constable Sizwe Zungu, along with his written affidavit, contradict each other.
Advocate Zithulele Nxumalo addressed the high court in Pretoria where accused No.: 4 Mthokoziseni Maphisa was applying for the charges against him to be dismissed.
Five men are on trial for the 2014 murder or the Bafana Bafana captain.
Constable Zungu is the only witness called who placed all the accused at a hostel in Vosloorus on the evening of the murder.
Nxumalo says Zungu does not place Maphisa in a vehicle that’s alleged to have been driven during the commission of the murder.
“It is clear that Zungu does not place the accused No.: 4 travelling together, using the VW polo that is alleged accused No.: 5 was using leaving the hostel. ‘He then saw accused one, following each other, going towards the room. And he followed them inside the room. Accused one was in possession of a special revolver, and accused number three was in possession of a 9 millimeter pistol. Accused 5 came inside the room. He was followed by a number 4’. He then says in his affidavit … it does not mention No.: 4 following accused number 5 to Gwabini’s room. These are material contradictions between Zungu’s evidence in chief and his written statement,” says Zungu.
Nxumalo: Zungu evidence does not say he overheard such a plan to assasinate the deceased.
