A trial within a trial at the Free State High Court in Bloemfontein on May 5, 202 to test the court’s jurisdiction of former Premier, Ace Magashule’s PA, Moroadi Cholota’s extradition claims.
The trial within a trial in the R255 million asbestos roof removal case will resume today in the Bloemfontein High Court in the Free State.
The matter was postponed last Thursday after a state witness, the investigating officer, fell ill.
Judge Phillip Loubser was expected to deliver a ruling on whether other defence lawyers can cross-examine the state witness who is an investigating officer in the asbestos case.
Last week, Ace Magashule’s legal representative, Laurence Hodes, requested to cross-examine the state witness.
Magashule was the Premier of the Free State at the time of the alleged illegal awarding of the multimillion rand tender.
Moroadia Cholota was the Premier’s Personal Assistant.
She was previously positioned to be a state witness.
But according to the investigating officer, Cholota became uncooperative in 2021 when she was interviewed by investigators in the USA.
As a result, authorities decided to have her arrested and extradited to South Africa to face charges alongside Magashule and others.
Cholota is currently challenging the legality of her extradition from the US in a trial within a trial.
