The Expropriation Act will not ensure transfer of land from landowners to those dispossessed of land under colonialism and under the Apartheid government.
This is according to lawyer and author of the Land is Ours, Advocate Tembeka Ngcukaitobi.
President Cyril Ramaphosa signed the Expropriation Bill into law on Thursday.
Expropriation Act | ‘Law is highly procedural, vague and contradictory’: Adv Tembeka Ngcukaitobi
Ngcukaitobi says there is a misconception that private property is at risk of being expropriated.
“For those who have no land because land was taken away by force, by trickery and theft under colonialism and Apartheid, the bill is symbolic only at an aspirational level. It will not in fact transfer land from landowners to the dispossessed and marginalised people.
South African government is very committed to private property as a concept, wrongly in our argument, certainly in my argument, wrongly. It is very committed to private property, in fact it worships private property.”
