Johannesburg City Manager Floyd Brink has been ordered to vacate his position within 10 days or once an acting manager is appointed. This comes after a High Court ruling declaring his re-appointment unlawful, unconstitutional and invalid in a matter brought before the court by the Democratic Alliance (DA).
However, City of Johannesburg Mayor Dada Morero has assured residents that his administration will ensure there are minimal to no disruptions to the Metro’s administration.
The High Court in Johannesburg has upheld a previous ruling when handing down judgment on Wednesday morning. Last year the court handed down a judgment setting aside Brink’s permanent appointment.
But, in a fight to keep Brink in his position, he was re-instated following a council vote, prompting the Democratic Alliance to take the matter to court, citing Brink’s appointment was procedurally flawed.
“Any employment contract and performance contract has now been set aside and declared unlawful. But Judge Wilson has also awarded the DA costs. The court has upheld what the DA maintained that the dooms day coalition and its unconstitutional conduct will not stand,” says Belinda Kayser-Echeozonjok, Joburg Caucus Leader: Democratic Alliance.
Morero says the legal department is still studying the judgment.
“Now I’ve just started the judgment and then make a call. If the call says this is what we have to do then and uphold the court’s decision, and it will then have the implications it will mean that we have to appoint someone who will act in his position. Those are the decisions we will need to make once we’ve been advised by our legal team,” says Morero.
Floyd Brink was reappointed on 29 November last year.
