The National Prosecuting Authority (NPA) will pursue the complaint against the retired Mpumalanga Chief Magistrate Tuletu Tonjeni.
NPA spokesperson Kaizer Kganyago says they will also approach the provincial regional court president to assign another magistrate to hear the appeal regarding the contempt of court and arrest warrant issued against state prosecutor Mkhuseli Ntaba.
Tonjeni issued an arrest warrant for Ntaba, who failed to attend a bail hearing for taxi boss Joe Sibanyoni and his co-accused at the Kwaggafontein Magistrate’s Court.
The matter of Sibanyoni, Bafana Sindane, and two others was then struck off the roll in the Kwaaggafontein Magistrate’s Court last week.
This prompted the NPA to lodge a complaint against her with the Magistrates Commission and also re-enrolled the matter.
Kganyago say, “The National Prosecuting Authority has submitted the complaint with the Magistrates Commission and the complaint was more about the conduct of a magistrate. Therefore, we want them to get to the bottom of it so that it can be of assistance to even other people going forward.”
“Now that the matter has been reported while she was still in office, we will just await what the Magistrates Commission will do and how they are going to handle it. The ball is now in their court,” adds Kganyago.
