Counsel for Dr Nandipha Magudumana, led by Advocate Anton Katz, tells the Constitutional Court that the extradition is a bilateral event between two states and argues that her deportation was the subversion of international law. This was part of their arguments in the ConCourt while contesting the legality of Magudumana’s 2023 deportation from Tanzania to South Africa.
Katz says Magudumana’s deportation was rather an abduction than a lawful extradition.
Magudumana has taken her appeal to the ConCourt after her failed bid at the Supreme Court of Appeal in Bloemfontein. In her application, she stated that her deportation was unlawful and invalid.
Katz says Magudumana was brought to South Africa in a disguised extradition.
“In order to appreciate what this concept of a disguised extradition is we would submit a pressed principle that looks at what is an extradition. We say extradition is a bilateral event between two states.”
