Eastern Cape top Judge President Selby Mbenenge faces possible impeachment. This after the Judicial Services Commission (JSC) overturned the Judicial Conduct Tribunal’s ‘misconduct’ finding against him.
The JSC has instead handed Mbenenge a sanction of ‘gross misconduct’ in the landmark sexual harassment probe.
This after Judges’ Secretary Andiswa Mengo had accused Mbenenge of alleged sexual harassment in the form of in-person interactions and electronic communications between June 2021 and November 2022
In a statement issued today, the Judicial Service Commission (JSC) says that following representations from parties, the commission did not accept findings of the Tribunal that Mbenenge is guilty of misconduct not amounting to gross misconduct.
The JSC instead says that Mbenenge’s conduct constitutes gross misconduct, placing him in the realm of possible impeachment.
The matter will now be referred to the National Assembly for a vote where a two-thirds majority is required for impeachment.
