Legality of my appointment will not affect public confidence: Mothibi


The National Director of Public Prosecutions (NDPP), Advocate Andy Mothibi, says concerns over his appointment will not affect public confidence in the institution.

On Wednesday, the High Court in Johannesburg reserved judgment in a case that a law firm, B Xulu and Partners, has brought challenging the legality of his appointment.

The firm argues the process was unconstitutional.

This after the interviewing panel found no suitable candidates.

Mothibi himself was not among those who were interviewed.

However, President Cyril Ramaphosa appointed Mothibi in January, citing his constitutional prerogative.

Mothibi maintains that the NPA’s integrity remains intact.

“I do not think that [the legal challenge] has an impact on the independence of NPA or our ability to do the work. For now, I’m focused on the work at hand and as you can see, some of the results are clear for the public to see.”

“[Regarding] the appointment process … those who are unhappy with it, they have got a forum, which they have approached, which is the courts of law. I’m informed that the matter [was] heard and adjudicated upon from today. So, I will not really pronounce further on that,” explains Mothibi. -Reporting by Thabang Morutloa
