Mbeki joins Zuma to challenge Khampepe’s refusal to recuse herself


Former President Thabo Mbeki has filed papers in the Gauteng High Court in Johannesburg to join former President Jacob Zuma’s review application to challenge Justice Sisi Khampepe’s refusal to recuse herself as Chairperson of the Truth Reconciliation Commission (TRC) Cases Inquiry.

Amongst reasons advanced, Mbeki says Khampepe applied a subjective not an objective standard on the issue of bias.

Secondly that Khampepe’s argument that the Inquiry’s Terms of Reference start from 2003, after her roles at the National Prosecuting Authority (NPA) and Amnesty Committee, overlooks that the Commission will have to investigate the origins of the alleged interference which can only be found prior to that date.

Mbeki also seeks an order that President Cyril Ramaphosa terminate Khampepe’s appointment, as well as to declare all decisions, proceedings, acts by the Commission that involved her null and void.
