Batohi admits she didn’t read Cato Manor case dockets


National Prosecuting Authority (NPA) Head Adv Shamila Batohi has admitted to the Nkabinde Inquiry, she did not read the case dockets implicating members of the Cato Manor Unit in serious crimes.

She is facing cross-examination on her evidence presented to the commission into suspended South Gauteng Prosecutions Head Andrew Chauke’s fitness to hold office.

Batohi says she relied on an internal memo and a report from the KwaZulu-Natal Director of Public Prosecutions (DPP) when dropping racketeering charges against Major General Johan Booysen and the unit.

Under cross-examination by Chauke’s counsel Adv Tembeka Ngcukaitobi, Batohi argued that National Directors are not required to study entire dockets before making prosecutorial decisions.

Ngcukaitobi: You gave evidence earlier that you did not study the docket when you took the decision to institute a disciplinary case against Adv Chauke, but you relied on the report of Adv De Kock. You never studied the docket, is that not correct?”

Batohi: Yes, that’s correct, but I also relied on report of the DPP KZN and I did not study the dockets, The 23 dockets.”
