Batohi to face cross-examination at Nkabinde Enquiry


National Director of Public Prosecutions, Advocate Shamila Batohi, will face cross-examination when the Nkabinde Enquiry resumes in Pretoria on Friday morning.

She wrapped up two weeks of testimony on Thursday.

Batohi said expert advice informed her decision to refer suspended Gauteng prosecutions head Andrew Chauke’s case to President Cyril Ramaphosa.

The enquiry is investigating Chauke’s fitness to hold office.

He’s accused of shielding high-profile individuals, including former Crime Intelligence head Richard Mdluli, from facing justice.

Advocate Batohi said she thought she wouldn’t be cross-examined, but the enquiry’s chairperson, retired Constitutional Court Justice Bess Nkabinde, strongly disagreed.

Judge: “I made it clear in chambers that you will not be cross-examined. Did I understand you to say that?”

Batohi: “That is correct, chairperson.”

Judge: “It is important to put context to that question. To that answer rather. And place it correctly on record. That it is not correct that I said that you will not be cross-examined.”

Batohi: “Chairperson, if I may. I certainly did not mean that you acted improperly in any way at all. I really apologise if that’s the way it came across.”
