Judge queries NDPP powers as Batohi appears before Chauke inquiry


Presiding Judge Bess Nkabinde has questioned the timeframes under which the National Director of Public Prosecutions can intervene or take a matter on review. Nkabinde posed the question to NPA head Shamila Batohi.

Advocate Batohi was appearing before Judge Nkabinde’s Inquiry into the fitness of suspended South Gauteng Director of Public Prosecutions, Andrew Chauke, to hold office in Pretoria.

Judge Nkabinde questioned how such action may impact the people involved.

“Yes, chairperson. If the interest of justice exists. Because policy directives were not complied with, that should be done. As I sit here today, I will think that the NDPP will have to look at what really happened to access if something untoward happened. Because policy directives were not complied with.”
