The uMkhonto Wesizwe Party is accused of violating its own constitution by not following internal procedures when the leader of the party in Mpumalanga Mary Phadi was expelled.
Advocate Zandile Mshololo, who is representing Phadi, told the high court sitting in Mbombela that the party was treating its members unfairly.
Phadi was expelled in October last year for alleged violation of the party’s constitutional and misappropriation of party funds.
The high court reinstated her as the party’s provincial leader in December.
The MKP is challenging the court’s decision.
“The fact that a member has subjected to serve, to being a member, and accepted the membership of the party, it does not necessarily mean, my lord, that the party can now then do as it wishes. The president of the party cannot, therefore, just take a decision to terminate a member without following the procedure, firstly, my lord, of their own constitution and secondly, the constitution of the country, my lord,” argued Advocate Moshololo.
