Zuma, MKP fail to revive challenge against Mchunu’s leave of absence


The High Court in Pretoria has dismissed former President Jacob Zuma and the uMkhonto we Sizwe Party’s bid to revive their legal challenge against President Cyril Ramaphosa’s decision to place Police Minister Senzo Mchunu on a special leave of absence.

The court also dismissed the challenge to the subsequent appointment of Firoz Cachalia as Acting Minister as well as the establishment of the Madlanga Commission.

The High Court, found among other things that the exercise of a power to suspend a Minister is reasonably necessary when it is not apparent whether the facts warrant the dismissal of a Minister or not.

In addition, the court found that the decision to establish the inquiry as a step to answer this question cannot be faulted from a legality and rationality vantage point.

The application was subsequently dismissed, and each party is to bear its own costs.
