Suspended Ekurhuleni Head of Legal and Risk Services Advocate Kemi Behari says he has never interacted with witness D also known as Marius van der Merwe and the allegations against him are unfounded.
Van der Merwe was killed in an apparent hit in Boksburg last year. Behari has on Monday morning taken to the stand at the Madlanga Commission in Pretoria probing allegations of corruption in the criminal justice system.
Behari has previously been accused of shielding suspended Ekurhuleni Metro Police Deputy Chief, Julius Mkhwanazi, by crafting an internal legal report that cleared him.
He has defended himself before the Commission.
“Where I have been referenced by Witness D in the process because I have never had any dealings with the Witness D throughout my life and throughout my career at Ekurhuleni. More especially it concern me because when I looked at the record in the transcript of Kelebogile Thepa there seems to have been a place where her evidence ended and immediately thereafter the evidence of witness D commenced in the same record so I sought clarity I haven’t got clarity but I don’t have any dealings with witness D.”
