Modack and 14 co-accused face over a hundred charges, including murder
The state presented electronic device location pins, or pings, to the Western Cape High Court in Cape Town, in the trial of underworld figure Nafiz Modack and his co-accused Zane Killian.
Prosecution is slowly moving to prove a case that the two accused had a relationship that allegedly led to the murder of top cop and anti-gang unit member, Charl Kinnear.
During cross-examination, the State told the court that Killian had several code names for Modack.
Modack and 14 co-accused face over a hundred charges, including murder, attempted murder, running a criminal enterprise and money laundering.
State Prosecutor Greg Wolmarans made use of cell phone screenshots to show code names allegedly used by Zane Killian, in reference to Nafiz Modack.
Among the charges Modack faces is the attempted murder of criminal defence attorney William Booth.
Wolmarans displayed several screenshots, allegedly relating to pings of different people, including that of Booth on the day of his attempted murder.
The screenshots are used by the State to establish that Killian allegedly acted on Modack’s instruction.
Each of the pings has a reference attached to it, indicating on whose behalf it was done.
Accused Nafiz Modack says, “My lord, I have so much references already that I’m myself confused, my lord. At least 8 or 7 references, my lord. Different references, my lord.”
State prosecutor Advocate Greg Wolmarans adds, “Is it hard to keep track? You want me to go through it again? Yes, please. For Mr. Booth and his wife…ja ….The relevant references are bow boss boss, Nafiz, 3, Mo, and boss. For Mr. Valli, the references are Naf, Naf, and bow boss boss. Now we’ve come to Andre Naude, also in March of 2020, failed ping, and the reference is bow boss boss.”
Modack denied that the code names are references to him or that Killian acted on his instructions.
However, Modack did admit earlier in the trial that he made use of Killian’s services.
The prosecution also earlier put it to Modack that he enlisted the services of Killian to ping the phone of Kinnear to have the top cop killed.
Modack insists, among others, that he was gathering evidence of alleged collusion between Kinnear and another alleged gang boss, Jerome Booysen, to give to crime intelligence.
Cross-examination is expected to continue on Tuesday.
