The High Court in Pretoria is hearing suspended Deputy National Police Commissioner for Crime Detection, Lt-General Shadrack Sibiya’s bid to have him re-instated, on September 3, 2025.
The lawyer representing suspended Deputy Police Commissioner for Crime Detection, Shadrack Sibiya, has argued that the processes followed by National Commissioner Fannie Masemola to suspend him are unlawful.
His suspension is for his alleged involvement in the unlawful disbandment of the KwaZulu-Natal political killings task team.
Sibiya wants the High Court in Pretoria to declare his suspension invalid and unlawful.
Advocate Kameel Premhid has argued that Sibiya’s leave of absence is unlawful.
He says, “He has the power to discipline, but the discipline has to comply with the regulations and if I can show you that there’s no stay-at-home power in the regulations, then the order to stay at home is unlawful, in the same way that I’ve been debating with Justice (Graham) Moshewana. That’s the point.”
