Lawyer for National Police Commissioner Fannie Masemola has argued that the application brought before the High Court by Deputy Police Commissioner for Crime Detection Lt. General Shadrack Sibiya is premature.
Advocate Stefan Coetzee has argued that Masemola’s actions in issuing Sibiya with a stay-at-home order are justified because it would allow investigations to continue without any hindrances.
Sibiya, who was suspended by Masemola in July following explosive corruption allegations made by KZN Police Commissioner Nhlanhla Mkhwanazi, wants his suspension declared invalid and unlawful.
Advocate Coetzee says, “This is a lawful instruction given to that police officer to go home to allow the investigation on the scene of this incident. How would that differ from the instruction that the National Police Commissioner gave his second-in-command to say to him? Go home while we look at what has happened here. The applicant, as a senior police officer, is well aware of the disciplinary code as we see in making frequent references to that.”

Meanwhile, Sibiya has been summoned to appear before parliament’s Ad hoc committee.
The ad hoc committee is investigating allegations made by Mkhwanazi of police interference and corruption within law enforcement agencies.
Shadrack Sibiya argues that processes followed by Masemola to suspend him are unlawful:
