Defence counsel consults with the accused in the Senzo Meyiwa trial.
Defence counsel Charles Mnisi and lead investigator Bongani Gininda in the Senzo Meyiwa trial, have been at loggerheads on the procedure of interviewing a witness and taking down a statement.
Advocate Mnisi has been cross examining Brigadier Gininda on the interview that led to the confession of accused number one Muzi Sibiya, shortly after his arrest in May 2020. Sibiya and four others are on trial at the High Court in Pretoria for the 2014 murder of the Bafana Bafana captain, Senzo Meyiwa.
Advocate Mnisi insists Gininda’s interview with Sibiya should have been treated as an official statement. While Gininda argued on the contrary, “In terms of the best practice rule, it’s advisable that someone independent document the confession.”
