The Nkabinde Inquiry has announced that evidence leaders have submitted the revised formal list of potential witnesses on Wednesday.
The Inquiry, led by retired Judge Bess Nkabinde, is looking into suspended South Gauteng Director of Public Prosecutions, Advocate Andrew Chauke’s fitness to hold office.
NPA head, Advocate Shamila Batohi, accused Chauke of making misguided prosecutorial decisions related to high-profile cases, including those of the Cato Manor death squad and former Crime Intelligence boss Richard Mdluli.
Inquiry spokesperson Tiyisela Mpuzana says the revised list was accompanied by estimates of the anticipated duration of each witness’s testimony.
This follows the head of the National Prosecuting Authority (NPA) Advocate Shamila Batohi, excusing herself from the ongoing cross-examination this week, without submitting a formal application for excusal to the panel.
Mpuzana says this affected the planned schedule and sequence of witnesses.
The panel is expected to request an extension of the original four-month timeframe for the inquiry, which is due at the end of January.
Mapuzana says the recent submissions will assist the panel in determining the likely timeframe for the conclusion of the inquiry proceedings.
“On the same day, the legal team representing Advocate Andrew Chauke also submitted their corresponding list of potential witnesses. These submissions will assist the Panel in determining the likely timeframe for the conclusion of the Enquiry proceedings.”
Mapuzana adds: “The information gathered through this process will enable the Panel to assess whether it is necessary to seek an extension of the Enquiry’s gazetted timeframe. Any such request in relation to the inquiry’s mandate, which is currently due to conclude at the end of January 2026, will be submitted to the President through the Minister of Justice and Constitutional Development, Ms Mmamoloko Kubayi.”
