Outgoing National Prosecuting Authority head, Advocate Shamila Batohi.
Evidence leaders at the Nkabinde enquiry in Pretoria will today apply for a postponement until next week Tuesday due to the absence of additional witnesses.
This follows the conclusion of testimony by former KwaZulu-Natal Director of Public Prosecutions, Advocate Moipone Noko, on Friday.
The enquiry is investigating the fitness of South Gauteng Director of Public Prosecutions, Advocate Andrew Chauke, to hold office.
Meanwhile, the first witness, former National Director of Public Prosecutions Advocate Shamila Batohi, has been granted permission to appoint legal counsel after walking out mid cross-examination in December last year.
Justice Bess Nkabinde has instructed both legal teams to submit their applications and responding affidavits over the weekend.
“Take the following order, this matter is postponed to Monday the 9th of February 2026 at 9am to the evidence leading team will file an application for the postponement as they indicate by Saturday the 7th of February 2026. This application will be argued on Monday the 9th at 9am.”
