Nafiz Modack in the dock
Alleged underworld figure, Nafiz Modack says he is not behind the murders and attempted murders he has been charged with.
Modack is on trial in the Western Cape High Court along with 14 others and is charged with the murder of Nico Heerschap, the father of a former Hawks investigator, the murder of Anti-Gang Unit detective, Charl Kinnear and the attempted murders of William Booth and alleged underworld figure, Andre Naude.
Together, the 15 accused face over 100 charges, including some under the Prevention of Organised Crime Act.
Heerschap was gunned down outside his Melkbosstrand home in an apparent case of mistaken identity in 2019.
Modack says he was not aware that he was under investigation by the Hawks officer and therefore had no reason to want to harm him or his family.
“There were only a few people doing the investigation, so I couldn’t have known. I did not know that there was an investigation by Heerschap.”
He also testified that Andre Naude, allegedly in charge of nightclub security in Cape Town before he facilitated a takeover in 2017, didn’t retaliate and therefore was not a problem for him.
Modack says he had nothing to do with an alleged attempt on Naude’s life.
“In 2017, the club security was assigned to TSG. So, there couldn’t have been a reason for me to harm him in 2019. They never came back [to target me], he wasn’t a problem for me. I have no idea why Mr A went to shoot at the house of Naude.”
Modack also faces charges of ordering an alleged hit on AGU detective, Charl Kinnear, who was shot and killed outside his Bishop Lavis home in September 2020.
But he has admitted to hiring the services of former rugby player turned debt collector, Zane Kilian, to track Kinnear’s location.
He says it was because he believed Kinnear to be involved in a plot to have him assassinated.
Kinnear was investigating Modack at the time of his murder. The trial continues.
