The R255 million asbestos trial in the Free State High Court which resumed this morning has been postponed to tomorrow following a brief appearance.
This is to allow the prosecution to prepare written submissions replying to accused 17 Moroadi Cholota‘s request to have a trial within a trial.
Cholota’s lawyer, Advocate Loyiso Makapela, told the court that it was imperative to have a trial within a trial to test the court’s jurisdiction to put her on trial.
She told the court that at every court appearance, prior to the trial, the prosecution had been emphatic that the matter of jurisdiction should be raised at the criminal trial stage.
She states that this is the time for the state to show that Cholota’s extradition was lawful.
