The uMkhonto weSizwe (MK) Party has turned to the North Gauteng High Court in Pretoria in an urgent bid to revive its challenge against President Cyril Ramaphosa’s decision to place Police Minister Senzo Mchunu on a leave of absence.
This, after the Constitutional Court refused the party direct access in July, citing that the matter did not fall within its exclusive jurisdiction.
The party seeks to invalidate President Ramaphosa’s related decisions, that is, to place Mchunu on a leave of absence, the appointment of Prof. Firoz Cachalia as Acting Minister of Police and the establishment of the Madlanga Commission of Inquiry.
Former President Jacob Zuma, in an affidavit, argues, among other things, that the “leave of absence manoeuvre is unprecedented” and that it can never be to the benefit of the people to pay two Ministers occupying the same portfolio.
As a result, the MKP seeks to have the President’s three related decisions reviewed and set aside.
