Economic Freedom Fighters’ (EFF) leader Julius Malema has written to President Cyril Ramaphosa seeking the establishment of a Commission of Inquiry into the state of the National Prosecuting Authority (NPA) in terms of Section 84(2)(f) of the Constitution of the Republic of South Africa, 1996.
Malema cites recent remarks by NPA Head Advocate Shamila Batohi of alleged infiltration in the NPA as the reason behind the request.
He further states that this is a matter of grave constitutional significance and that the country is now “confronted with a systemic breakdown of a constitutional institution and a direct threat to the rule of law”.
Malema further requests that such a Commission be chaired by retired Chief Justice Mogoeng Mogoeng, who according to the EFF leader, held a tenure that was “independent from political influence”
Malema calls on the President to act decisively to restore the integrity of the prosecutorial system, not only for the sake of its functionality but to reaffirm the country’s collective commitment to justice, accountability and the rule of law.
