Magudumana’s lawyer optimistic as matter heads to ConCourt

Nandipha Magudumana’s lawyer Machini Motloung says he will focus on the dissenting judgment as he takes his client’s fight to nullify her arrest in Tanzania to the Constitutional Court.

Magudumana remains in jail.

She had fled the country with convicted rapist and murderer, Thabo Bester, in 2023 when they were arrested in Tanzania.

Last month, Magudumana suffered a legal blow when the Supreme Court of Appeal dismissed her application.

She had approached the court to request that it reverse the Free State High Court’s judgment, dismissing her application to have her arrest nullified.

Magudumana had made the request on the basis that she had consented to be brought back to South Africa.

Motloung explains his defence strategy: “Where we are now, we still firmly stand by the grounds of appeal that we presented in the SCA- but obviously, over and above that- the issues that emanate from the dissenting judgment, are quite compelling in our view- and worthy of being pursued further in the Constitutional Court.”

“So there are a conglomeration of factors that we’re raising in our papers – which we would want to fully and expansively ventilate in the Constitutional Court,” adds Motloung.
