This submission aims to oppose the recent proposal by the Minister of Communications and Digital Technologies, Solly Malatsi, to exempt Elon Musk’s satellite operator Starlink from compliance with South Africa’s Broad-Based Black Economic Empowerment (B-BBEE) requirements in the ICT sector.
Chairperson of Public Interest SA Tebogo Khaas says, “There are concerns that we’ve raised, Chief among them being legal and procedural concerns around this proposed exemption. For instance, we believe firmly that there may be overreach on the part of the Minister of Communications, and we know that the issue of equity equivalence rests within the Department of Trade and Industr and obviously, whatever proposals he may have those have to be approved or sanctioned by the Department of Trade and Industry. Having said that, it appears that there’s no alignment between the two departments.”
