The legal showdown between the Information Regulator and the Department of Basic Education plays out in the High Court in Pretoria. This is after the Regulator filed an urgent application to stop the annual publishing of the matric results in newspapers.

Class of 2024

The results of the Class of 2024 are released next week.

Chairperson of the Information Regulator Pansy Tlakula says the Department’s intention to release matric results in newspapers doesn’t comply with the Protection of Personal Information Act.

She says publishing the results will be in breach of privacy laws. “During the assessment, we came to a conclusion that their processing does not comply particularly with section 11 of POPI Act which provides that anyone who processes personal information can do so without obtaining consent if they consent of the data subject; if they can prove that processing protects the legitimate interest of the data subject and in this subject the learners.”
