Lawyer recuses himself in Magaqa murder case, hearing postponed

The legal representative of one of the accused in the assassination of former African National Congress (ANC) Youth League Secretary-General Sindiso Magaqa has recused himself, resulting in the case being postponed to next month.

The recusal comes after the state made an application for the lawyer to recuse himself from the case, citing a conflict of interest.

Magaqa was murdered in 2017 with two other councillors, for allegedly being vocal critics of how the Umzimkhulu Municipality used the finances for the refurbishment of a Memorial Hall.

The High Court in Pietermaritzburg advised Sibonelo Myeza to secure new legal representation by the 20th of November. It also advised him against representing himself, as this was a grave case.

Myeza, who was representing himself after his lawyer Shane Matthews recused himself, asked the court to be patient with his search for a suitable lawyer.

He told the court that it would be difficult, as he had worked with Matthews for 6 years and they had a financial agreement in place.
