Kubayi orders NPA to submit all unsigned extradition requests

Justice Minister Mmamoloko Kubayi has instructed the National Prosecuting Authority (NPA) to provide all extradition requests that have been submitted but were not signed and authorized by the previous administration’s minister.

Kubayi says this is to prevent any further challenges in terms of cases before the court that involve the extradition of different individuals.

This after the high court in Bloemfontein ruled that the extradition of former Free State Premier’s personal assistant, Moroadi Cholota from the US was unlawful.

The court also ruled that it lacked the jurisdiction to try Cholota on the offences she was charged with, as the State provided false information to the US authorities in her extradition.

“As we go over within as part of the judgment being written, reading through what is written, I think the NPA will be obligated to pronounce publicly the way forward and what this is implicated. From my side as the Minister, I have emphasized the need for NPA to look at all the cases that we have before the Court to ensure that we have management of those cases. But also, to ensure that the successful prosecution,” says Kubayi.
