Judgment on Mapisa-Nqakula’s docket disclosure to be delivered today

Judgment in an application to disclose Section C of the corruption docket against former National Assembly Speaker Nosiviwe Mapisa-Nqakula will be delivered in the Pretoria High Court this morning.

Mapisa-Nqakula is facing 12 counts of corruption and one of money laundering for allegedly receiving kickbacks while she was the Minister of Defence.

Her defence lawyers believe that the disclosure of the investigating diary could exonerate their client. But, state prosecutor Paul Louw has argued that the section of the docket relating to the investigating diary contains privileged information.

“The C-section, and I quote, of the docket is the investigating diary and does not contain evidence. It contains privileged and confidential information pertaining to the investigation in the context of the affirmance made through the applicant’s founding affidavit. Nowhere is a case made that the disclosure of the C-section is relevant to the applicant’s fair trial,” says Louw.
