Judgment in the matter between the uMkhonto we Sizwe Party (MK Party) regarding former National Director of Public Prosecutions (NDPP) Shamila Batohi’s pension has been reserved.
The MK Party approached the North Gauteng High CouHigh Court in an urgent bid to block Advocate Batohi’s pension payout.
The urgent bid by the MKP comes amid allegations of misconduct, dereliction of duty and possible perjury levelled against Batohi during her tenure as NDPP.
Advocate Batohi’s legal counsel, Advocate Geoff Budlender, has argued that the MKP’s application before the High Court should be dismissed because it is baseless.
“Why would a political party do this? What would its motive be? I’m not going to speculate; I’d rather stick to the facts. But the fact that such a bizarre application is brought is reason enough to suspect that there’s some other motive which is ulterior to the proper purposes of litigation. There is something else afoot here, and it is an ulterior purpose, whatever it may be. It’s not so difficult to speculate”, he said.
