Eastern Cape Judge President Selby Mbenenge
Eastern Cape Top Judge, Judge President Selby Mbenenge remains on special leave. This was confirmed by the office of the Chief Justice.
The statement, issued on Wednesday, says that the leave will remain in effect until the Judicial Service Commission (JSC) has concluded its consideration of the report of the Judicial Conduct Tribunal which makes a finding of misconduct – a lesser sanction which does not fall in the realm of impeachment.
The Judicial Conduct Tribunal Mbenenge guilty of misconduct for initiating a flirtatious relationship with his secretary Andiswa Mengo on social media platform WhatsApp. However, the tribunal found the Judge not guilty of impeachable misconduct following the incident which happened between June 2021 and November 2022.
The JSC is scheduled to convene a sitting for consideration of the Tribunal’s report, on 5 March 2026.
