The trio, convicted for the disappearance of Joshlin Smith, is expected to launch an application for leave to appeal in the High Court in Cape Town on Tuesday.
Joshlin’s mother, Kelly Smith, along with Steveno van Rhyn and Jacquen Appollis, were sentenced to life imprisonment on charges of human trafficking and ten years for kidnapping.
The matter has been set down for two days.
The issue of the Section 204 witness, Laurentia Lombaard, will also be heard to determine whether she should be criminally charged.
Lombaard turned state witness during the trial that sat in Saldanha Bay on the Cape West Coast.
It’s been nearly a year and a half since Joshlin Smith disappeared, sparking a search that still hasn’t yielded answers.
The girl, who was six years old when she disappeared from the Middelpos informal settlement at Saldanha in February last year, has still not been found.
