The investigating officer (IO) in the bail application of a prominent musician, Lehlohonolo Chauke, popularly known as Shebe Maburna, has refuted claims that the complainant was present in court on the day when one of his assault cases was withdrawn.
Warrant Officer Phaladi Makola is being cross examined by defense lawyer, Lot Ramusi in the Polokwane Magistrate’s Court.
This relates to an assault charge that was laid in 2015 at the Mankweng Magistrate’s Court.
The charge was withdrawn without the complainant being present in court. Makola says there is evidence to prove this emphasising that it will be unfair to the magistrate because they have proof that the complainant was not in court.
“The complainant also stated that he was not in court. There’s a diary entry stating that the complainant was not found. And surprising is that when the complainant first he got a call from the police, he got a call from me. If you check the feedback of the from the complainant when the case was opened, there was no feedback that was given to the complainant,” says Makola.
